Terms of Service & Liability Waiver

Welcome to the website and services of Jaclyn “Jacks” Keith (“we,” “us,” “our”). By accessing this website and/or purchasing any class, workshop, retreat, event, or service from Jaclyn “Jacks” Keith, you agree to be bound by the following Terms of Service and Liability Waiver. If you do not agree to these terms, please do not use this website or purchase any offerings.
1. All Sales Are Final
All sales are final and non-refundable. This includes, but is not limited to, classes, workshops, retreats, events, and any related offerings. By completing your purchase, you acknowledge and agree that no refunds, transfers, or credits will be provided for any reason, including but not limited to change of mind, scheduling conflicts, personal circumstances, travel issues, illness, or inability to attend.
2. Assumption of Risk
You acknowledge that participation in physical movement, yoga, pilates, reformer pilates, fitness, wellness practices, workshops, and retreats involves inherent risks, including but not limited to physical injury, emotional distress, illness, accidents, or property loss. You voluntarily choose to participate and assume full responsibility for any and all risks associated with your participation.
You confirm that you are medically, physically, and mentally fit to participate and that you have consulted with a qualified healthcare professional if you have any concerns about your ability to safely take part.
3. Waiver and Release of Liability
By purchasing any class, workshop, retreat, or service from Jaclyn “Jacks” Keith, you knowingly, voluntarily, and expressly waive, release, and discharge any and all claims against Jaclyn “Jacks” Keith for any injury, loss, damage, illness, emotional distress, accident, or death arising from or related to your participation, whether occurring before, during, or after participation.
You agree that Jaclyn “Jacks” Keith shall not be held liable for any injuries, losses, damages, or claims connected to your participation in any activity or use of the website, except where liability cannot be excluded under applicable UK law.
4. Personal Responsibility
You acknowledge that you are solely responsible for your own health, safety, and wellbeing. You agree to participate at your own pace, modify activities as needed, and stop any activity that causes pain, discomfort, dizziness, or concern. You accept full responsibility for your choices and actions.
5. Media Release (Photography & Video Consent)
By purchasing and/or participating in any class, workshop, retreat, or event, you grant Jaclyn “Jacks” Keith the irrevocable right to photograph, film, record, and otherwise capture your image, likeness, voice, and participation.
You agree that these images and recordings may be used for promotional, marketing, educational, and commercial purposes, including but not limited to social media, website content, advertisements, and future promotional materials, without compensation to you. 6. No Medical or Professional Advice
All classes, workshops, retreats, and content are provided for general wellbeing and educational purposes only and do not constitute medical, therapeutic, or professional advice. You agree that you are responsible for seeking professional guidance where appropriate.
7. Website Use
You agree to use this website for lawful purposes only. You may not misuse the website, interfere with its operation, or use content without permission.
8. Intellectual Property
All content on this website, including text, images, videos, branding, logos, and materials, is the property of Jaclyn “Jacks” Keith and may not be copied, reproduced, distributed, or used without prior written consent.
9. No Guarantees
Individual results and experiences vary. Jaclyn “Jacks” Keith makes no guarantees regarding outcomes or benefits from participation in any class, workshop, or retreat.
10. Changes to These Terms
Jaclyn “Jacks” Keith reserves the right to update or modify these Terms of Service at any time. Continued use of the website or purchase of services after changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of Scotland, United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
